Orders for beers and ales ("Products") are subject to the following Terms and Conditions with Fellows Brewery Limited ("The Brewery");

1.0         Age. You must be aged over 18 years and capable of entering into a contract. You will be required to supply proof of age on request.

2.0         Availability. All products are subject to availability.

3.0         Payment. Payment in full must be made by cash or by cheque on delivery of your order unless prior agreement has been made with the The Brewery. 

4.0         Retention of Title. All goods remain the property of The Brewery until paid in full. In the event of sale of the goods by the customer prior to payment, the customer shall hold the proceeds of the sale as the trustees for The Brewery in such a way as to be identifiable as the property of The Brewery. Where it is not possible to identify the specific goods then we reserve the right to claim for all monies outstanding.

 5.0         Delivery. All goods must be examined on delivery and claims or breakages, or loss, must be notified at the point of delivery. The Brewery will not accept responsibility for any breakages, or loss, after the goods have been signed for. All products must be signed for by an adult (aged 18 years or over) on delivery. By signing for a delivery from The Brewery, you are deemed to have accepted the Terms and Conditions of sale.

6.0         Sale or Return. Products are not supplied on a ‘sale or return’ basis unless an agreement has been made in writing prior to delivery with The Brewery.

7.0         Third Party Contracts. We will not accept orders where they would breach a beer tie or other contracts that the buyer holds with a third party. The website (www.fellowsbrewery.co.uk) or other marketing materials produced by The Brewery is not intended as an inducement to breach any contract, which may exist between a tenant & their landlord to purchase beers or any other products. We treat the buyer placing an order with us as the buyer’s confirmation that there is no such tie.

8.0         Casks and Kegs. All casks and kegs remain the property of The Brewery. Any casks or kegs delivered by The Brewery must be collected by The Brewery. If casks or kegs are not returned within a reasonable time or are damaged or lost, then the customer will be charged for the cask or keg.

9.0         Warranty. The Brewery warrants that Products shall be free from defects in materials and workmanship and fit for human consumption at the time of delivery. The Brewery‘s only liability in respect of Products supplied in breach of such warranty, whether arising out of its negligence or otherwise, shall be at its option, to grant credit at the invoiced price or to replace such Products as soon as reasonably practicable provided that in all cases the allegedly faulty Products are returned within fourteen days from the date of delivery and are found after examination not to have complied with the above warranty.

10.0     Privacy policy. If we hold your contact details, we will use them only for contacting you in connection with any order you have placed, or to inform you of new products, special offers, forthcoming events and the like. We will never sell or pass your details on to other companies. 11.0     Limitation of liability. We shall not be liable to pay any compensation to you, other than any refund as provided above. In particular, but without limitation, we shall not be liable to you for loss of profit, damage to goodwill or any indirect or consequent loss or damage arising out of any damage, defect, negligence or other failing on our part. Nothing in these terms shall limit any rights you may have which are not capable of being lawfully excluded or limited, nor shall it exclude or restrict our liability to you for any death or personal injury resulting from our negligence. 

12.0     Intellectual property. No permission is given by us in respect of the reproduction or use for commercial or detrimental purposes of any brand names, product names, designs and other material shown on or connected with our website in which intellectual property rights exist. Fellows Brewery®, Old Fellow®, Crafty Fellow® and Jolly Fellows® are registered trademarks of The Brewery.

13.0     Governing law. These terms shall be governed by and construed in accordance with English law and all parties shall submit to the exclusive jurisdiction of the English courts. If you have any queries or complaints please write to Fellows Brewery Limited, Cambridge, CB24 8XS
